TERMS OF POLICIES AND CONDITIONS
🚵 Informed Consent for Mountain Bike Tours in Cusco
Buho Tours (the “Company”), a provider of active tourism services, duly authorized to operate adventure activities, with current civil liability insurance, established emergency protocols, and professionally trained personnel, provides the present Passenger Informed Consent for your knowledge and unconditional acceptance.
I. 📝 Declaration of Voluntariness and Risk Acknowledgement
Voluntary Participation: I declare that my participation in the bicycle tour is voluntary, and I have been informed that it takes place in a natural and mountainous environment, which entails inherent difficulties in communication and access, especially in case of emergency.
Terrain and Weather: I acknowledge that the activity takes place on uneven terrain (trails, tracks, etc.) and is subject to climatic contingencies (rain, storm, hail) that may lead to its immediate suspension, even during the tour, at the Guide’s discretion.
Foreseeable Risks of the Activity: I understand that mountain biking is a physical activity that carries foreseeable risks, including:
Muscle fatigue, dehydration, and sun exposure.
Falls that may cause contusions, cuts, abrasions, and fractures.
Insect stings or bites from other species.
Any accident or injury sustained during the ride is the sole responsibility of the cyclist, who assumes all corresponding transfer and medical expenses.
Company Commitment: Buho Tours commits to adopting and implementing all appropriate prevention and safety measures relevant to the circumstances and to providing a trained guide to accompany the group.
II. 🛡️ Responsibility, Safety, and Insurance
Assumption of Risk: Before commencing the service, I will sign the Release of Liability (waiver), where I acknowledge and accept the inherent risks of mountain biking as an adventure sport.
Mandatory Personal Insurance: It is an emphatic and mandatory requirement that the passenger holds their own health, accident, and/or travel insurance with express coverage for adventure sports and mountain activities.
All medical, hospital, or evacuation expenses resulting from accidents that occur during the tour are the exclusive responsibility and cost of the client and are not included in the service price.
Mandatory Safety Equipment: The use of a helmet is strictly mandatory. Furthermore, depending on the MTB discipline (e.g., Enduro or Cross-Country), the use of gloves, knee pads, and elbow pads will be required. The Guide reserves the right to prohibit participation if this requirement is not met.
Adherence to Guides’ Instructions: The cyclist commits to following the Guide’s instructions, safety guidelines, and decisions at all times.
Guide’s Discretion: If the cyclist’s physical or technical condition is not suitable for the tour, or if a storm/rain approaches in the Andes of Cusco, the Guide has the final authority to modify, cancel, or prematurely terminate the service for the group’s safety.
III. 🚲 Equipment and Material Conditions
Personal Bicycles: If the client uses their own bicycle, it must be in perfect working condition for the type of terrain. The Company is not responsible for mechanical failures of personal equipment.
Bicycle Rental:
The client is entirely responsible for the rented bicycle and protective gear from the moment of handover until its return.
Any damage (beyond normal wear and tear) or loss/theft of the rented equipment will be covered by the client at the full cost of repair or replacement with a new part (international price, e.g., frame, cranks, brakes, tires, helmet, etc.).
Personal Gear: It is the client’s responsibility to bring appropriate personal gear (warm clothing, sunglasses, suitable footwear, sunscreen, etc.).
IV. 💰 Booking and Payment Conditions
Reservation and Deposit: A completed reservation form and the payment of a 50% deposit or advance payment of the total amount are required to secure and confirm the spot.
Full Payment: The remaining total amount for the tour must be settled a minimum of 7 days (one week) prior to the scheduled start date of the service.
Minimum Participants: For group tours, a minimum of 1 to 6 cyclists is required. If this minimum is not met, the Company may cancel the tour. (Private tours are not subject to this condition).
V. ❌ Cancellation and Refund Policies
A. Cancellation by the Client:

| 30 days or more before the tour | 50% of the deposit paid will be retained as an administrative fee. |
| Less than 30 days before the tour | Considered a “No Show” (failure to appear). 100% of the total payment will be retained as a penalty. |
B. Cancellation by the Company:
Due to Minimum Participants or Operational Reasons: A full refund of the money paid will be offered, or the option to use the amount as credit for a future tour.
C. External Circumstances (Force Majeure):
In the event of extreme weather conditions, natural disasters, or unforeseen events that necessitate cancellation after the tour has commenced for the safety of the tourist, no refund will be applied, and 100% of the total service payment will be retained.
VI. 🤝 Conduct and Acceptance of Limitations
Respect: It is mandatory to respect local laws and cultures, as well as the privacy of other participants and trail users (farmers, hikers, other cyclists).
Skill Level: The client must be honest about their technical skill level and physical condition. The Guide may make strict decisions regarding participation if the cyclist’s level puts the safety of the group or their own safety at risk.
